    How to make a Freedom of Information Request

  • The Freedom of Information (FOI) Act 2000 gives you the right to request information from public authorities, such as Corby Borough Council.  The FOIA helps people get a better understanding of how public authorities, such as Corby Borough Council, carry out their duties, make decisions and spend public money.

    Your request will be answered within 20 working days.  However, if the request is considered complex and voluminous, it can be extended to 40 days.

    When making a request, please try to be specific.  The more information provided, the easier it is for the Council to provide an accurate and quick response.

    Fees

    You will not normally be charged for making an FOI request, but if Corby Borough Council estimates that gathering the information costs more than £450.00 (which equates to 18 hours), then your request will be refused. You will however be given the opportunity to narrow down your request or pay the cost of gathering the information.  You may also be charged for any necessary copying and postage charges in sending the information to you. Where a fee is charged in respect of this, you will be advised and it will be necessary to pay this fee before the information is released.  If the fee is not paid within three months of the original request, the request will be considered lapsed.

     

    Access to Information

    The supply of documents under the FOIA is protected by the Copyright, Designs and Patents Act 1998. You do not have an automatic right to re-use the information for commercial gain (e.g. by making multiple copies, publishing, and issuing copies to the public without permission of the Council).

    Please note that under Freedom of Information (FOI) Regulations, neither the Electoral Registration Officer (ERO) nor the local Returning Officer (RO) fall within the jurisdiction of FOI requests.

    Homelessness - Please be advised that information relating to Homelessness is collated by Central Government from the P1E quarterly returns provided by Local Authorities. These live tables, which are updated on a quarterly basis. 

    Licenses – Five councils within Northamptonshire (Corby, Daventry, East Northamptonshire, Kettering and Wellingborough) have combined resources and set up a centralised unit to administer the processing of all licences under the Licensing Act 2003 e.g. sale of alcohol, regulated entertainment, late night refreshment etc, Gambling Act 2005 e.g. betting shops, gaming machines , gambling premises, raffles / lottery registrations etc and the Environmental Health Licensing e.g. tattoo, animal boarding, street collections, riding establishments etc.  The Central Administration Unit can be contacted at licensingunit@east-northamptonshire.gov.uk

    NNDR Accounts In Credit – Following a recent ICO Decision Notie FS50619844 (February 2017), the Council no longer publishes its NNDR Credit Balances Dataset.  The Council agrees with the Exemption 31(1((a) arguments presented and that on balance 

    Full Property List With Exemptions/Full Property List With Reliefs - Please note that Corby Borough Council will no longer be publishing these details under Section 31(1)a of the Freedom of Information Act 2000 - the prevention or detection of crime, as the release of the information is likely to prejudice the Council's security systems and/or processes and the Council cannot see any public accountability or transparency arguments that enables it to fully consider the public interest arguments for disclosing this information.  Therefore, there is no likely benefit to the wider public in releasing this information.
