NOTICE OF PUBLIC FOOTPATH DIVERSION ORDER

TOWN AND COUNTRY PLANNING ACT 1990, SECTION 257

AND PARAGRAPH 1 OF SCHEDULE 14

NORTH NORTHAMPTONSHIRE COUNCIL

FOOTPATH GZ11 CHURCH PIECE WILLOW LANE STANION 2021

  1. North Northamptonshire Council (Council) gives notice that it has confirmed the above Order without modification.
  2. The effect of the Order is to divert the footpath GZ11 at Church Piece Willow Lane Stanion measuring 115.5 metres long which runs from point A (NGR SP 9159, 8686) to point C (NGR SP 9169, 8681) and is shown by a solid red line on the attached plan (Plan); and create an alternative footpath GZ11 at Church Piece Willow Lane Stanion measuring 120 metres long and 2 metres wide which runs from point B (NGR SP 9158, 8685) to point C (NGR SP 9169, 8681) and is shown by a broken purple line on the Plan.
  3. A copy of the confirmed Order and Plan Footpath GZ11 at Church Piece Willow Lane Stanion may be inspected free of charge at the Council Offices at Municipal Building Bowing Green Road Kettering NN15 7QX between the hours of 9am and 5pm Mondays to Fridays (excluding bank holidays and public holidays) from the 20th May 2021 to 1st July 2021. A copy may also be viewed on the Council's website www.northnorthants.gov.uk.
  4. The Order comes into force on the date on which the Council certifies that the terms of Article 2 have been complied with.
  5. Any person aggrieved by the Order and wishing to question its validity, or any provision contained in the Order, on the ground that it is not within the powers of the TCPA 1990 or that any procedural requirement of the TCPA 1990 or any regulation made under the TCPA 1990 has not been complied with in relation to the confirmation of the Order may within six weeks from 20th May 2021 apply to the High Court under section 287 of the TCPA 1990.

FOOTPATH GZ11 CHURCH PIECE WILLOW LANE STANION

 

 

 

This order is made by the Corby Borough Council under section 257 of the Town and Country Planning Act 1990 because it is satisfied that it is necessary to divert the public footpath to which this order relates in order to enable development to be carried out in accordance with planning permissions:

1        14/00135/OUT  -  Allowed on Appeal (ref APP/U2805/W/15/3035908)

 

2        18/00688/RM – decided under appeal 22 August 2019

 

granted under Part III of the Town and Country Planning Act 1990 by the Corby Borough Council for the erection of 11 dwellings and access road

 

 

BY THIS ORDER

 

1.       The footpath GZ11 over the land shown by the solid blue line on the attached plan (‘the Plan’) and described in Part 1 of the Schedule to this order (“the Schedule”) shall be diverted as provided below.

 

2.       There shall be created to the reasonable satisfaction of Northamptonshire County Council an alternative public footpath for use as a replacement for the existing footpath as provided in Part 2 of the Schedule and on the Plan.

 

3.       The diversion of the footpath shall have effect on the date on which Northamptonshire County Council certify that the terms of Article 2 above have been complied with.

 

4.       Where immediately before the date on which the footpath is diverted there is apparatus under, in, on, over, along or across it belonging to statutory undertakers for the purpose of carrying on their undertaking, the undertakers shall continue to have the same rights in respect of the apparatus as they then had.
